GENERAL
By using and/or visiting this website you agree to all the terms and conditions of use for Vocalo.org. If you do not agree to any of these terms, please do not use Vocalo.org

USE OF SITE
Accounts
In order to use some features of Vocalo.org you will have to create an account. When creating your account you must provide accurate and complete information and are solely responsible for the activity that occurs on your account. You must keep your account password secure. You must notify Vocalo.org immediately if you believe there has been unauthorized use of your account. When you create an account you must not use a false or misleading name or a name that you are not authorized to use. Impersonating another person on Vocalo.org is prohibited.

Interaction
Vocalo.org is a community of people and use of this site is voluntary. When you interact with Vocalo.org and/or submit Materials including audio, video, photos, text etc. you must take care to think of this larger community. You agree that you will not 1) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Vocalo.org all the license rights granted herein; 2) publish falsehoods or misrepresentations that could damage Vocalo.org or any third party; 3) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate 4) post or disseminate advertisements or solicitations of business 5) impersonate another person. 6) solicit any user for material gain or produce spam throughout the site publicizing a product or event.

Materials or text that is found to violate the rules set above may be removed without prior notification. Vocalo.org does not endorse any Materials submitted by users or any opinion, recommendation, or advice expressed there in and we expressly disclaim any and all liability in connection with User Materials. Users who repeatedly violate the rules of Vocalo.org and who have been properly notified will have their Materials and Account removed from Vocalo.org and are not permitted to join under a separate name.  In addition, Vocalo.org permits you to link to Materials on the site for personal, non-commercial purposes only. Those found to use Materials that they do no own for commercial gain will be blocked from Vocalo.org

Third Party Sites
Vocalo.org allows users to link to third-party websites. Vocalo.org has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. By using our site you expressly relieve Vocalo.org or its agents of any and all liability arising from your use of any third-party websites connected to our site.

You understand that when using the Vocalo.org site, you will be exposed to Materials from a variety of sources, and that Vocalo.org is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to the use of Materials. You further understand that you may be exposed to Materials that are inaccurate, offensive, indecent or objectionable and you agree to waive any legal or equitable rights or remedies you have or may have against Vocalo.org and agree to indemnify and hold Vocalo.org its agents, owners/operators, affiliates ad/or licensors harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

Automated Systems
You agree not to use or launch any automated system that accesses Vocalo.org in a manner that sends more request messages to our servers in a given period of time than a human can reasonably produce in the same period by using a conventional online web browser. Such as robots, spiders or offline readers. However, Vocalo.org may grant operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the Materials, but not caches or achieves. Vocalo.org may revoke these exceptions at any time.

Warranty Disclaimer
You agree that your use of the Vocalo.org website shall be at your sole risk. To the fullest extent permitted by law, Vocalo.org its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the website and your use thereof. Vocalo.org makes no warranties or representations about the accuracy or completeness of this site's content or the content of any sites linked to this site and assumes no liability or responsibility for any 1) errors, mistakes, or inaccuracies of content 2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website 3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein 4) any interruption or the cessation of transmission to or from our website 5) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our website by any third party, and/or 6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Vocalo.org website. Vocalo.org does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Vocalo.org website or any hyperlinked website or featured in any banner or other advertising, and Vocalo.org will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgement and exercise caution where appropriate.

Limitation of Liability
In no event shall Vocalo.org, its officers, directors, employees, or agents be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any 1) errors, mistakes, or inaccuracies of content, 2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website 3) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein 4) any interruption or the cessation of transmission to or from our website 5) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our website by any third party, and/or 6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Vocalo.org website, whether based on warranty, contract, tort or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

You specifically acknowledge that Vocalo.org shall not be liable for Materials submitted or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you. from our website,

Indemnity
You agree to defend, indemnify and hold harmless Vocalo.org its parent organization, affiliates, subsidiaries, officers and directors, agents, employees and partners, and any parties with whom Vocalo.org may contract to provide its services, from any third party claim or demand, including reasonable attorneys' fees for damages and /or costs due to or arising out of your breach of your representations, warranties or obligations under this Agreement and/or in connection with your use of the services and Materials available on Vocalo.org

Modification or Amendment of Agreement
We reserve the right, in our sole discretion, to change, modify, add or remove all or part of this Agreement. Notice of any amendments and/or modifications shall be posted to _______  area at least three days prior to their effective date. In the event that you do not consent to any such amendments and/or modifications, your sole recourse shall be to terminate thie Agreement. Modifications to sections of Agreement shall not affect the validity and enforceability of the remaining provisions.

Digital Millennium Copyright Act
We respect the intellectual property of others. If you believe that your copyrighted Materials have been copied in a way that constitutes infringement, please follow the procedure set form in our Digital Millennium Copyright Act Notice Policy, which is expressly incorporated herein by reference and made a part of this Agreement.

Ability to Accept Terms of Serivce
You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are to fully  able and competent to enter into the terms conditions, obligations, representations and responsibilities set for in this Agreement, and to abide by and comply with this Agreement.
